Data controller
Swilop Developers, based in Montería, Córdoba, Colombia. Contact for personal data matters: contacto@swilop.com. This policy is issued under Colombian data protection law — Law 1581 of 2012 and Decree 1377 of 2013, now part of Decree 1074 of 2015 — which governs how we handle your data wherever you are.
Data we process
Identification and contact details (name, email and WhatsApp number), the information you share about your project, and data about where your visit came from (page, referring site and campaign parameters). We do not ask for sensitive data or for data about minors.
Purposes
We process your data to: (a) respond to your requests and contact you by WhatsApp, email or phone; (b) prepare and send you proposals and quotes; (c) perform and manage any contract we sign with you, including invoicing; (d) learn which channels bring us clients and improve the site; and (e) meet our legal, accounting and tax obligations.
Consent
We obtain your prior, express and informed consent through the checkbox on our form, which is never pre-ticked, or through the channel you use to contact us. We keep a record of that consent.
Transfers to service providers
To operate, we use web hosting, storage and email delivery providers, some with servers outside Colombia. With your consent, your data may be transferred to those providers so they can process it on our behalf, solely for the purposes in this policy.
Third-party data in client projects
When we build a system or automation that processes data about our clients' own customers, we act as a data processor: we follow the controller's instructions, use the data only for that project and agree by contract on where it is stored and which AI providers process it.
Your rights
You have the right to: access, update and correct your data; request proof of the consent you gave us; be told how we use your data; file complaints with the Superintendence of Industry and Commerce (SIC), Colombia's data protection authority; withdraw your consent or request deletion of your data, unless a legal or contractual duty requires us to keep it; and access your personal data free of charge.
Inquiries
You can ask about your data by emailing contacto@swilop.com. We answer within ten (10) business days of receiving your request. If we cannot meet that deadline, we will tell you why and give you a new date, no more than five (5) additional business days later.
Complaints
If you believe your data should be corrected, updated or deleted, or that we have broken the law, email a complaint to contacto@swilop.com with your identification, a description of the facts, your contact address and any supporting documents. If the complaint is incomplete, we will ask you to complete it within five (5) business days; if two (2) months pass without a response, we will consider it withdrawn. We answer within fifteen (15) business days, extendable by eight (8) more business days with prior notice. Under Colombian law, this process must be completed before filing with the SIC.
Security
We apply reasonable technical and administrative measures to protect your data: encrypted connections, access limited to our team, and providers with security controls in place.
Effective date
This policy is effective from the updated date shown on this page. We keep your data for as long as it is needed for the purposes described and for the periods required by law. Any material change will be posted on this page before it takes effect.
